In a Thursday statement, Samsung Electronics' spokesman James Chung revealed that a recent ruling by a Dutch court has prevented the South Korean electronics company from pursuing injunctions against iPhone-maker Apple for infringement of standards-essential patents as long as Apple appears to be keen on negotiating license deals.
Stating that a court in Hague had rejected Samsung's 3G patent bid aimed at banning the sales of the Apple iPhone and iPad in Holland, Chung however also added that the court had allowed its company to seek damages pertaining to the use of Intel chips --- a verdict which marks a partial win for Samsung in its legal scuffle with top-rung smartphone makers of the world.
About the Dutch court's Wednesday ruling in Samsung's intensifying patent fight with Apple, Chung said that, according to the court, the sales of iPhones and iPads will continue in the country since it could not be said for sure that Apple had failed to abide by the clauses on FRAND - fair, reasonable and non-discriminatory - terms, which underline a licensing obligation for industry-standard patents.
Nonetheless, while noting that the court ruling prevented Samsung from asserting 3G patents against Apple devices running Qualcomm's baseband chips, Chung added that the verdict also implied that "Apple should negotiate with Samsung on royalties."
In a statement, in reaction to the Hague court verdict, Samsung said that the ruling "provides Samsung with a legal basis to move forward with the protection of our patent rights."
